Foreclosure Defense
Foreclosure litigation and defense. You have 20 days to answer the summons. A letter, call, or even a pending loan modification, is not an answer. You will be in default and waive your defenses if you fail to answer. Don’t waive your rights or bury your head in the sand. This will not go away by itself. Defaulting makes the case go faster. We may be able to get more time to answer even if your time has expired. We brief and argue opposition to bank motions for summary judgment.
Loan Modification
Loan modification – to try to reduce monthly payments and catch up on arrears in a new payment schedule. The process takes months. It starts with a trial payment plan and then a permanent agreement. We also handle reinstatement and forbearance agreements. This is not a DIY job. We often fix problems where the servicers play games. We attend the mandatory foreclosure settlement conference in the Supreme Court and hold the bank to the required good faith standard.
Chapter 13 Bankruptcy
Chapter 13 plans to pay mortgage arrears and credit cards. Frequently, unsecured debts can be paid less than 100%. The process is complex. Pro se (unrepresented) homeowners almost always fail. The phases include the petition and schedules, 341 (trustee) meeting, and confirmation hearing (for judge approval of the plan).
