WHAT ARE THE STEPS?

You will need to have credit counseling which can be done by phone or online.  After we prepare your bankruptcy petition and schedules, we will set a date for you to come to the office to review and approve them.  That is your chance to make any final changes.  Once you sign the papers we will scan them into pdf format and file them electronically with the court.  Attorney Scott Lanin is registered with the courts to file cases online.   The Court will then assign a trustee.  We will send the trustee all of the mandatory papers required to be served.  In Chapter 13 cases, we will serve the plan on all creditors.  About one month later, we will attend a meeting at the court with you called the 341 hearing or meeting of creditors. The trustee will confirm your identity and ask you questions under oath about the papers and your finances.  Chapter 13 bankruptcy requires at least two meetings — the meeting of creditors and the confirmation hearing. You will need take a financial education course.  Eventually, the case will be completed.  In Chapter 7, you will get a notice of discharge.  In Chapter 13, the case will be completed after you make your plan payments.
